THE STATUTE, READ 16 AUGUST 2026, AND BOTH SECONDARY ACCOUNTS OF IT ARE WRONG IN OPPOSITE DIRECTIONS. 129 articles. ARTICLE 52 lists the Central Waqf Council's functions and CONTAINS ZERO OCCURRENCES OF بيع (sale) AND ZERO OF رهن (mortgage); across the whole file رهن occurs exactly once, in Article 59. Article 52's disposal power is 52(ك) alone: 'البت في طلبات استبدال العقارات الوقفيَّة كافَّة، بما فيها الجوامع والمساجد الخَرِبَة والمؤسسات الخيرية والمقابر المندرسة', deciding applications to EXCHANGE endowment properties, reaching ruined mosques and prayer halls, charitable institutions and effaced cemeteries. WHAT ELSE ARTICLE 52 CONTAINS, and Chapter 4 v6 carries it because v5 had read the article as an exchange power and nothing else: استثمار nine times, تأجير four, المشاركة once, البناء والتشغيل once. 52(ط) approves partnership and investment contracts; 52(ي) the investment of movable waqf including participation in approved Islamic banks and Islamic insurance companies; 52(ف) the rules for investing and leasing; 52(ق) build-operate-transfer; 52(ت) ratification of lease and investment contracts. ARTICLE 59(a) IS THE PROHIBITION, NOT THE LOOPHOLE: 'لا يجوز بيع الأوقاف، ولا التنازل عنها بالمجان ولا ببدل، ولا انتقالها بطريق الإرث، ولا رهنها، ولا عقد تأمين عليها.' ARTICLE 64(a)(2) QUALIFIES IT: settling a pre-existing encroachment is by exchanging one property for another, 'وفي حال تعذُّر ذلك بسبب طبيعة المخالفة فيجوز الاستبدال بالنقد بموافقة مجلس الأوقاف المركزي', and 64(b) evicts the occupant if no settlement is reached within a year. SO: SRC-112, The Syria Report of 9 June 2021, is wrong that Article 52 permits sale or mortgage; SRC-045, SNHR, mislabels Article 59, which forbids what SNHR says it enables. The register carried this contradiction unresolved from 10 August to 16 August 2026 and it took one retrieval.
